MY HEALTH LEGACY – TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of My Health Legacy, provided by RealBusiness Inc, a Delaware corporation (“Company,” “we,” “us,” or “our”).
By creating an account or using My Health Legacy, you agree to these Terms.
1. What My Health Legacy Is
My Health Legacy is a patient-directed digital platform designed to help individuals and families securely store, organize, and share health-related and life documents at their discretion.
My Health Legacy:
- Is not a healthcare provider
- Does not replace medical care
- Does not provide medical advice or diagnosis
- Does not act on behalf of healthcare providers
You remain fully in control of your data and how it is shared.
2. Eligibility
You must:
- Be 18 years of age or older
- Have the legal authority to upload and manage records you add
- Obtain proper authorization before uploading records of another person (e.g., a parent or child)
By using the service, you represent that you meet these requirements.
3. Account Registration & Security
You are responsible for:
- Maintaining the confidentiality of your login credentials
- Ensuring that access to your account is secure
- All activity occurring under your account
We recommend enabling multi-factor authentication (MFA) where available.
4. Health Records & User Responsibility
You may upload documents such as:
- Medical records
- Medication lists
- Imaging and lab reports
- Legal documents (advance directives, powers of attorney)
- Insurance and billing records
- Identity documentation
You confirm that:
- You have the right to upload and manage each document
- Information you upload is accurate to the best of your knowledge
- You understand documents may be relied upon by family or care teams in emergencies
5. User-Directed Sharing
All sharing within My Health Legacy is explicitly user-directed.
Sharing Features Include:
- View-only access by default
- Optional limited download permissions
- Identity-verified recipient access
- Time-limited expiration
- Full audit logging visible to the user
- Immediate revocation by the user
The Company does not independently distribute or disclose your records.
6. Emergency Use Disclaimer
My Health Legacy is designed to support emergency preparedness, but:
- Does not guarantee availability in all situations
- Does not replace emergency services (call 911 in emergencies)
- Does not verify accuracy of uploaded records
You and your authorized representatives are responsible for ensuring records are complete and current.
7. AI Features Disclaimer
Artificial intelligence may be used to:
- Assist with organization
- Suggest categories
- Extract metadata from documents
- Provide general informational guidance
AI outputs:
- Are not medical advice
- May contain errors or omissions
- Should always be reviewed by the user
No AI function substitutes for clinical judgment.
8. Subscription Plans & Billing
My Health Legacy offers:
- Free and paid subscription tiers
Paid features may include expanded storage, AI capabilities, and sharing controls.
Cancellation:
- You may downgrade or cancel at any time
- Upon cancellation, a grace period allows data export
- After the grace period, data beyond free-tier limits may be deleted
- Users may retain access at the free level
9. Data Deletion & Export
You may:
- Download/export your data during your subscription or grace period
- Request deletion by contacting support
Some data may remain temporarily for compliance, security, or backup purposes.
10. Intellectual Property
All platform software, branding, and content (excluding your documents) belong to RealBusiness Inc.
You retain ownership of your uploaded content.
11. Privacy
Your use of My Health Legacy is governed by our Privacy Policy, incorporated here by reference.
12. Limitation of Liability
To the maximum extent permitted by law:
RealBusiness Inc shall not be liable for indirect, incidental, consequential, or special damages, including loss of data, health outcomes, or access delays.
Total liability shall not exceed the amount paid by you in the prior 12 months.
13. Indemnification
You agree to indemnify and hold harmless RealBusiness Inc from claims arising from:
- Unauthorized uploads
- Improper sharing
- Misuse of the platform
- Violation of these Terms
14. Arbitration & Class Action Waiver
Mandatory Arbitration:
All disputes shall be resolved by binding arbitration under the Federal Arbitration Act.
No Class Actions:
Claims must be brought individually. Class actions are waived.
15. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
